These terms and conditions govern your use of our website in section one and for classes in section two.

Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

Section one
1 - Website access
1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website
1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.
1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website uptime
1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.
1.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Visitor provided material
1.6 Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.
1.7 When using this website you shall not post or send to or from this website any material:
(a) for which you have not obtained all necessary consents;

Shipping
1.16 Your order will be processed and delivered without undue delay, no later than 5 – 7 working days after your order has been placed.
1.17 Please allow for up to 3 - 5 working days for delivery following the dispatch of your order.
Cancellations, returns and refunds
1.18 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
1.19 Your right to cancel an order for goods starts the moment you place your order and ends in 14 days from the day you receive your goods.
1.20 To meet the cancellation deadline, please notify us via email or phone about cancelling the order before the cancellation period has expired.
1.21 If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.
1.22 We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
1.23 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.
1.24 In addition you will lose your right to cancel if you:
(a) unseal goods that are not suitable for return if they are unsealed, due to resale and other points.

Law and jurisdiction
These terms and conditions are governed by English law. Any dispute arising in connection with them shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

Section two.
2 - For all activities in person at the studio
By enrolling in our in-person art classes, you agree to abide by the following Terms and Conditions. These apply to all participants, including children, young people, adults, and individuals with Special Educational Needs and Disabilities (SEND). These terms are accepted upon completing the Club Registration Form on the first day of attendance.

2.1. General Class Rules for Children, Young People, and Adults
Our classes are designed to foster a supportive, creative, and respectful environment. To ensure the safety and enjoyment of all participants, the following guidelines must be observed:

2.2 - For Children and Young People (Under 18 years of age):

  • Age Requirements: Children under 16 must be dropped off and collected by a parent or legal guardian. Written parental consent is mandatory and will be obtained on the first day of class through the completion of the Club Registration Form.
  • Supervision: Art Classes Group is responsible for the supervision of children during the class only. Parents or guardians must ensure their children are promptly collected at the end of each session. We cannot take responsibility for children outside class hours.
  • Behaviour: All children and young people must demonstrate respectful behaviour towards their classmates and instructors. Disruptive, disrespectful, or unsafe behaviour may result in removal from the class.
  • Use of Materials: All art materials are provided by Art Classes Group. Participants must use these materials appropriately and follow any safety instructions given by the instructor.

For Adults (18 years and over):

  • Respect and Conduct: All adult participants are expected to treat their peers and instructors with courtesy. Disruptive behaviour will not be tolerated and may result in exclusion from the class.
  • Materials: Art materials are provided, and participants are encouraged to handle them with care. Any intentional damage to the materials or studio property will be the responsibility of the participant.

For SEND Participants (Children, Young People, and Adults):

  • Inclusivity: Art Classes Group is committed to providing an inclusive environment for participants with Special Educational Needs and Disabilities. We ask that parents or carers inform us of any specific needs in advance to ensure that we can offer the appropriate support.
  • Adjustments: Reasonable adjustments will be made to accommodate SEND participants, ensuring they are able to fully participate in the class. We encourage open communication between the parents, carers, and instructors to ensure all needs are met.

2.3 - Class Cancellation Policy
Art Classes Group understands that participants may occasionally need to cancel or reschedule their attendance. The following cancellation policy applies:

  • Short Notice Cancellations: We accept cancellations at short notice. However, we kindly request that you provide at least 24 hours' notice when possible to allow us to offer your place to others.
  • Refunds and Rescheduling: If you cancel within 24 hours of the class, refunds may not be available. However, we will make every effort to reschedule your session, subject to availability. Refunds will only be issued in exceptional circumstances and at the discretion of Art Classes Group.
  • Class Cancellations by Art Classes Group: In the unlikely event that we need to cancel a class (e.g., due to instructor illness, adverse weather conditions, or unforeseen circumstances), we will inform participants as soon as possible. A full refund will be offered if paid in advance, or the participant will have the option to reschedule to a future class date. It will effect the membership card issued to the participant. (Membership card is valid for three month from the date of issue

2.4 - Safeguarding Policy
Art Classes Group is committed to ensuring the safety and wellbeing of all participants, with a strong focus on safeguarding children, young people, and vulnerable adults. Our safeguarding procedures comply with UK law and best practice guidelines.

2.5 - Children and Young People:

  • DBS Checks: All staff and instructors working with children and young people undergo an enhanced Disclosure and Barring Service (DBS) check to ensure they are suitable to work with minors.
  • Child Protection Training: Our team members receive regular training in child protection and safeguarding protocols.
  • Reporting Concerns: If a safeguarding concern arises, our staff are trained to report it following the appropriate legal processes. If you have any concerns about the welfare of a child or young person during a class, please inform a member of staff immediately.

2.6 - Vulnerable Adults and SEND Participants:

  • Safeguarding Vulnerable Adults: Art Classes Group follows UK safeguarding laws to protect vulnerable adults attending our classes. This includes ensuring that all staff are trained to recognise and report concerns.
  • SEND Participant Protection: We are committed to providing a safe and inclusive environment for SEND participants, and safeguarding procedures apply equally to children, young people, and adults with disabilities.

2.7 - Parental Consent and Legal Requirements

  • Consent for Minors: Parents or guardians of children under the age of 16 must provide written consent on the first day of class through the completion of the Club Registration Form. This consent confirms that the parent or guardian allows their child to participate in the art classes and understands the terms regarding supervision.
  • Responsibility Outside of Class Hours: Parents or guardians are responsible for ensuring their children are dropped off and collected on time. Art Classes Group will not be responsible for children outside of class hours.
  • Emergency Contacts: Parents must provide up-to-date emergency contact details when completing the Club Registration Form. This is essential to ensure we can reach you in the event of an emergency or if your child becomes unwell during the class.

2.8 Health and Safety

  • Participant Responsibility: All participants must follow health and safety guidelines during the class. This includes properly using art materials and equipment as instructed by the tutor.
  • Accident and Emergency Procedures: In the unlikely event of an accident, Art Classes Group will follow emergency procedures, including first aid, and contacting emergency services if necessary. Parents or guardians will be notified immediately.

3 - Agreement to Terms and Conditions
Completing the Club Registration Form on the first day of class confirms that you agree to and accept these Terms and Conditions. This agreement applies to all in-person classes provided by Art Classes Group.
We reserve the right to update these Terms and Conditions as necessary. You will be informed of any significant changes.
